Internal Regulations for Students of Nazarbayev Intellectual Schools
- General Provisions
- The internal regulations for students of Nazarbayev Intellectual Schools carrying out educational activities (hereinafter referred to as the Intellectual Schools) have been developed under the Law of the Republic of Kazakhstan “On Education”, the Charter of the autonomous educational organization “Nazarbayev Intellectual Schools” (hereinafter referred to as the AOO), the Development Strategy of the AOO until 2035, and the Rules of educational activities of the AOO “Nazarbayev Intellectual Schools”.
- These Rules establish the order of the educational process for students, requirements for the school uniform and student outlook, determine the rights, obligations, and responsibilities of students, the basic norms and rules of student behavior in the building, on the territory of the Intellectual Schools, as well as at all extracurricular activities, the procedures how to encourage students, resolve controversial issues, as well as organize school interaction with a student’s legal representatives.
- The purpose of these Rules is to create a safe, supportive educational environment that provides conditions for successful academic and social growth of students based on mutual respect between all members of the school community.
- These Rules are binding on all students of the Intellectual Schools.
- These Rules are posted on the websites of the AOO and Intellectual Schools.
- The administration, and tutors of the Intellectual School are obliged to familiarize:
- students and their legal representatives with these Rules in the following cases: when accepting documents for participation in the competitive selection against signature; when applying for admission to the Intellectual School against signature;
- students annually at the beginning of the academic year during tutor hours upon their signature in the Journal of Familiarization with the regulatory documents under Appendix 1 to these Rules.
- Issues not regulated by these Rules shall be resolved under the approved regulatory acts of the AOO and the current legislation of the Republic of Kazakhstan.
- The educational process in the Intellectual Schools
- To ensure student safety, entry/exit to/from the school is carried out exclusively through the Access Control and Management System.
- Students are not allowed to be in the Intellectual Schools unless it is related to the educational process:
– after the end of classes;
– on weekends and holidays.
- Classes are held following the schedule approved by the Director of the Intellectual School and are regulated throughout the academic year by the Deputy Directors for Academic Work and Educational Work.
The duration of an academic hour in Intellectual Schools is 40 minutes. The Intellectual School has the right to hold one-hour (60-minute) academic lessons, having previously agreed with the AOO. The duration of breaks between lessons is at least 5-20 minutes.
- The total duration of the educational process, including the standards for the academic workload, and the regime of the school day are regulated by the Rules of Educational Activities of the AOO.
- Requirements for school uniform and appearance of students
- The appearance of students must comply with generally accepted norms of business style in society and exclude defiant details:
- for boys (youths) – short classic or model haircut;
- for girls (girls) – long hair should be collected, medium length, tied with hairpins.
- A unified school uniform has been established in the Intellectual Schools, the sample of which is approved by the decision of the Board of the AOO.
- The introduction of school uniforms is aimed at implementing the secular nature of education and eliminating signs of social, property, and other differences between students.
- Requirements for school uniforms:
- dress style – business, classic;
- the school uniform is divided into casual and sports.
Everyday school uniform includes a classic plain shirt in white and blue or light pink. Mandatory elements are a tie and a chevron. It is allowed to wear a polo shirt with a white collar. Trousers for girls and boys should be loose-fitting and cover the ankles; for girls, the length of skirts should be below the knees.
Sports uniform (sports trousers and a loose-fitting T-shirt) is intended exclusively for physical education lessons, sports clubs, and sections, as well as for hiking trips.
- Wearing a school uniform a student is not allowed to wear:
- shoes that do not have backdrops (slippers, “slates”, etc.), shoes with high heels over 4.5 sm,
- wear clothes and symbols of a religious nature (hijab, niqab, burka, paranja, Sikh turbans Jewish hats-kippas, “Large” Christian crosses, etc.),
- expose body parts (belly, lower back, chest);
- wear bangs if they cover their eyes, as well as punk haircuts, pigtails, mustaches, and beards for young men,
- dye hair in different evocative bright colors,
- using bright and defiant cosmetics, tattoos,
- wear flashy jewelry, piercings, and bright manicures.
- Students are not allowed to enter the classes without a school uniform. If the requirements for school uniform and appearance are not fulfilled, the teacher or the curator has the right to send the student home, accompanied by a legal representative to bring the student’s appearance in order following the present Regulations.
- Basic Rights and Responsibilities of Students of the Intellectual School
- Students have a right to:
- obtain quality education under the educational program of the Intellectual Schools;
- a safe supportive learning environment free from discrimination, harassment, insults, humiliation, and intolerance;
- obtain information about the educational process, including academic performance;
- participation in the work of student self-government bodies of the Intellectual School;
- free use of information resources, sports, reading, assembly halls, computer labs, a library, textbooks, educational and methodological complexes, and teaching aids;
- to be encouraged for success in educational and creative activities;
- recess between lessons and vacations;
- obtain information about elective courses, club activities at the Intellectual School, and the opportunity to participate in competitions on entrepreneurship, sports, and creativity;
- receive social, pedagogical, psychological, and medical assistance from the specialists of the Intellectual School;
- transfer from one Intellectual School to another following the established procedure;
- familiarization with the rules;
- familiarize with the rules of conduct and disciplinary measures for their violation;
- protection from unfounded accusations of violation of these Rules and the possibility of providing evidence.
- Students are obliged to:
- comply with the requirements of these Rules, the AOO Charter, the Regulations of the Intellectual School, decisions of the Pedagogical Council and student self-government bodies of the Intellectual School, safety regulations, fire safety regulations, comply with the requirements of the administration and teaching staff to ensure the safety of the educational process;
follow the instructions of the administration, teachers, and tutors to ensure the safety of the educational process;
- attend the Intellectual School following the schedule of the educational process and not miss classes for no discernible reason;
- possess knowledge, skills, practical skills, and competencies following the requirements of the educational program of the Intellectual School, do home tasks on time;
- comply with the Rules of Academic Honesty on the part of students at Nazarbayev Intellectual Schools;
- be polite and honest, respect the dignity and equal rights of members of the school community, refrain from any actions that infringe upon or violate the rights of other individuals, including discrimination based on language, gender, nationality, religion, and other grounds;
- constantly inform legal representatives about academic performance, behavior, and organization of extracurricular activities;
- wear a school uniform, as established by the Intellectual School, to monitor the student outlook;
- take care of their health, strive for spiritual and physical self-improvement;
- take good care of the property of the Intellectual School, take care of its safety;
- keep textbooks and teaching aids, equipment (musical instruments, technical teaching aids) in serviceable condition;
- maintain cleanliness in the study area, in individual lockers, and in specially designated areas for eating;
- inform the administration, a teacher, and a tutor of circumstances that threaten the health and well-being of students and employees of the Intellectual School, as well as facts of threats to the educational process;
- know and respect the state symbols of the Republic of Kazakhstan;
- eat in specially designated places following the approved operating hours of the Intellectual School;
- take part in community service and social events (cleaning classrooms, adjoining territory, participating in social projects, practices, etc.);
- To ensure favorable conditions for the educational process in the Intellectual School, students are prohibited from:
- being late for classes, assemblies, morning gatherings, and other school-wide events without a valid reason;
- bringing or inviting strangers to the Intellectual School and leaving the school without permission from the tutor and administration;
- coming to classes in dirty, wrinkled clothes that do not meet the requirements for the school uniform and student outlook as established by these Rules;
- openly demonstrating affiliation with various fan movements, any parties, religious movements, etc.;
- using, selling, distributing, bringing to the school premises, advertising in the Intellectual School and beyond its boundaries the following substances and items: smoking and smokeless tobacco products, electronic devices with smoking mixtures (including electronic cigarettes, vapes, IQOS, Glo, flavorings and liquids for them, hookah, tobacco heating systems, dipping tobacco, etc.); alcoholic beverages (beer, gin and tonic and other beverages containing alcohol, spirits), containers, bottles and tin cans intended for bottling alcoholic beverages; energy drinks, narcotic, psychotropic, chemical and toxic substances, animal and insect poisons; as well as to appear at school and in public places in a state of alcoholic, narcotic, toxic or other intoxication;
- using obscene expressions and gestures, using foul language;
- participating in gambling, including cards, bets, lotteries, and lottery activities, as well as their distribution and advertising;
- bringing any items related to gambling (cards, gambling chips, etc.) onto the territory of the Intellectual School, manifestation of gambling addiction (ludomania);
- engaging in speculative activities, such as reselling goods or services to make a quick profit;
- bringing any type of weapon, sharp, cutting, piercing objects, explosives, pyrotechnic, psychotropic, chemical, flammable substances, matches, lighters, flammable objects, and other things that are incompatible with the requirements of the educational process;
- promoting and/or imposing religious beliefs; to incite interethnic hatred;
- using physical force to settle disputes, engage in extortion of any kind, exert any pressure on all participants in the educational process;
- engaging in any actions of intimate and/or sexual nature, including taking photos and videos, or threatening to use them;
- engaging in any form of sexual harassment, including actions of an intimate and/or sexual nature, to create and distribute photographs and videos of such actions and to threaten to use or distribute them;
- bringing about psychological harm to a member of the school community, another legal entity, or an individual (bullying, fighting, hooliganism, all types of bullying, cyberbullying);
- being in prohibited areas and premises (server rooms, cross-connections, archive, and storage rooms, attics, etc.);
- disseminating personal data of members of the school community, as well as filming, storing, and transmitting false information between students and other persons, including the use of wireless data transmission (AirDrop, WhatsApp, Telegram, Bluetooth, etc.), especially if this information discredits the honor and dignity of the Intellectual School or its members;
- transmission to the media and/or the global network without the prior consent of students, employees, administration of the Intellectual School, other individuals, and legal entities whose rights may be violated by committing such an offense;
- using other people’s things without the permission and knowledge of members of the school community, other individuals, and legal entities;
The Intellectual School is not responsible for the loss, damage, or theft of any personal belongings of students, such as electronic devices, mobile phones, photo and video cameras, jewelry, large sums of money, etc.
- Rules of Student Conduct
- Students come to the Intellectual School no later than 10-15 minutes before the start of classes in a clean and ironed school uniform the visual appearance of which should meet the requirements of these Rules.
- Upon entering the school, students must leave their outer clothing in designated individual lockers, and change shoes if necessary.
- Students are not allowed to use elevators and sanitary facilities designed for people with disabilities or limited mobility.
- Behaviour in lesson:
- before the lesson starts, students must prepare their workplace and everything they need for working in the class;
- when a teacher enters the classroom, students stand up to greet the teacher and sit down after the teacher has responded to the greeting and allowed them to sit down. In the same way, students shall greet any adult who enters the classroom during class time;
- class time is used by students for educational purposes only. During the lesson it is not allowed to raise the voice, be distracted, and distract others with extra conversations, games, and other activities not related to the lesson;
- the use of cell phones, smartphones, tablets, and other devices is allowed for educational purposes only. The use of the aforementioned devices in cases not related to the educational process is prohibited. Students should turn off, put away all technical devices, turn cell phones on silent mode and put away them from desks. In case of violation, the teacher has the right to withdraw the device for the entire lesson. In case of repeated violations of these requirements, the device shall be returned only in the presence of a student’s legal representatives;
- it is not allowed to leave the classroom without teacher’s permission. In case of emergency, a student shall ask the teacher for permission;
- at the end of the lesson, the student may leave the classroom with the teacher’s permission.
- Behaviour during break time.
School break time (between lessons) is intended for 1) moving students to another room, if necessary, following the schedule; 2) students’ rest and physical warm-up. Students should move leisurely along the corridor during break time; 3) eat in designated places; 4) make phone calls (if necessary); 5) visit the school library.
During school break time, students are prohibited from:
1) interfering with the rest of other students, talking loudly, including on mobile phones, shouting, and making noise;
2) pushing each other, throwing objects, and solving any kind of problems violently;
3) running on stairs and corridors, pushing each other, and sliding down the banisters.
- Behaviour in the canteen:
1) eating is allowed only in specially designated places following the approved work regime of the Intellectual School;
2) it is necessary to observe the rules of hygiene, i.e. entering the canteen without outer clothes, washing hands thoroughly before eating and collecting hair before eating.
3) enter the school canteen with no rush, no pushing or breaking the queue is allowed;
4) it is forbidden to make noise in the canteen;
5) it is necessary to keep the canteen clean – clean the table after eating;
6) it is necessary to keep waiting in the queue to observe the order when buying food and to follow the requirements of canteen workers.
- Behaviour during extra-curricular activities:
1) Students are required to undergo a safety briefing of instructions before conducting activities inside or outside Kazakhstan;
2) students should strictly fulfill all requirements of the accompanying supervisor
when carrying out mass events, avoid any actions that can be dangerous to their own lives and others;
3) students in and out of school should be bearers of high culture and respect local traditions, treat nature historical and cultural monuments, and personal and group property, with care, and keep their places of residence clean;
4) students should observe the rules, follow the established route of travel, stay in the location of the group, determined by the accompanying supervisor, and arrive at the venue promptly, observing the requirements for appearance and school uniform prescribed in these rules;
5) to strictly observe the rules of personal hygiene, to inform the accompanying worker in due time about deterioration of health or injury;
6) it is forbidden to use fire objects (torches, candles, fireworks, clappers, bonfires, etc.), to arrange lighting effects with the use of chemical, pyrotechnic, and other means capable of causing a fire.
- Procedure for registration of students’ absences
- Absences are excused in cases of:
1) student’s illness (a document of medical excuse (spravka) is provided);
2) doctor’s visit (a document of medical excuse (spravka) is provided);
3) absence in classes due to family issues for a period no more than 10 (ten) days per school year upon written request of the student’s legal representatives one day in advance after getting approval from the principal of the Intellectual School;
4) participation in subject Olympiads, competitions, and other events conducted for educational purposes;
5) skipping classes at the request of extracurricular organizations for participation in subject olympiads, competitions, and other events held for educational purposes.
- If a student misses classes due to illness, he/she shall notify the tutor on the first day of the illness and bring the document of medical excuse (spravka) the day he/she comes back to classes.
- In case of missing classes to participate in subject Olympiads, competitions, and other events organized by the Intellectual School, an entry shall be made by a tutor in the Unified Information Educational Space (ЕИОС).
- The following procedure shall be applied to absences requested by extracurricular organizations:
1) the legal representative shall notify the tutor one day beforehand and submit a written application to the Principal of the Intellectual School, attached official application from an extracurricular organization;
2) based on the student’s legal representative’s application, the principal decides on approval/rejection of the application. In case of approval, the Principal of the Intellectual School issues an order of approval.
- The legal representatives are responsible for the student’s completion of the study program material on missed days.
- Unexcused absences are recorded in the Unified Information Educational Space (ЕИОС) by the teacher on a daily basis. Students shall be subject to disciplinary liability for unexcused absences as stipulated in these Rules.
- Students’ incentives
- Students of the Intellectual School are rewarded for high results in academic activities, achievements in creative work, sports, and active participation in social life.
- The types of incentives are:
1) announcement of gratitude;
2) awarding a certificate of honor, a commendation certificate;
3) awarding the title ‘Student of the Year’;
4) awarding the title ‘Shanyrak of the Year’;
5) publication of information on promotion in internet sources of AOE, mass media.
- Incentives for students of the Intellectual School shall be coordinated by the Incentive Committee.
- The Incentive Commission members shall be approved by the order of the Principal of the Intellectual School for each academic year. The Incentive Committee shall be headed by a chairman, its members can be teachers, tutors, students of the Intellectual School, and representatives of the Parents’ Committee with re-election every 2 years. The members of the Incentive Commission can carry on their activities on a free-of-charge basis with a term of office of 2 years. Individuals appointed to the Incentive Committee, after the expiry of the term of office, cannot be reappointed to the Incentive Committee again.
- Public encouragement may be organised in the classroom, Shanyrak student community, during school assemblies, pedagogical councils.
- The Principal of the Intellectual School may establish other types of incentives not provided for in these Rules.
- Personal (individual) and general (collective) rewards, as well as the combination of multiple rewards to a student are allowed.
- Incentives should be officially issued by the order of the Principal of the Intellectual School and recorded in the student’s portfolio. The tutor should inform the legal representatives of the student, the school community in a solemn atmosphere (if possible) about the order of the Principal of the Intellectual School.
- Students’ responsibility
- Disciplinary violations are divided into 3 types according to severity:
1) minor;
2) major;
3) serious.
- Minor offences include:
1) violation of classroom management during academic and extracurricular activities, including the use of mobile phones, playing mobile games, and use of other devices that lead to a distraction from the learning process;
2) unexcused tardiness to classes, school gatherings, morning assemblies, whole school events;
3) wearing clothes that do not meet the requirements for school uniforms and students’ appearance, unkemptness, carelessness in wearing it;
4) failure to complete homework without a valid excuse;
5) consumption of food outside the designated places;
6) violation of the rules of behavior in the building, on the territory, and outside the Intellectual School;
7) violation of cleanliness in the premises of the Intellectual School, adjoining territory, and in the canteen, including noise, non-compliance with the rules of hygiene, waiting in the queue and cleaning up after meals; violation of the rules for the use of the school computers, stipulated by the Internal ACTAs of the Intellectual School;
8) damage to the Intellectual School property, property of other individuals, and legal entities through negligence.
9) playing on a device (computer, laptop, tablet, netbook, smartwatch, etc.) in the Intellectual School, except for educational and developmental games provided by the school program;
- Major violations include:
1) repeatedly committed violations classified as minor violations within 6 months from the date of commission (two or more) or commission of several violations at the same time;
2) not attending classes, elective courses, clubs, and other extracurricular activities without a valid excuse (more than 3 times per quarter);
3) inviting unauthorized persons into the school and/or leaving the school without the permission of the tutor, or school administration;
4) participation in gambling, including poker, bets, wagers, lotteries, and other lottery activities, as well as their distribution and advertising; bringing to the territory of the Intellectual School any items related to gambling (cards, playing chips, etc.), the manifestation of gambling addiction (ludomania);
5) ignorance and disrespectful attitude to the state symbols of Kazakhstan;
6) insulting the honor and dignity, infringement, violation of the rights of the school community members and other individuals;
7) use of obscene expressions and gestures, profanity;
8) open display of symbols and paraphernalia of religious movements or expression of sexual orientation, etc.;
9) broadcasting to the mass media and/or social network materials about students, employees, Intellectual School administration, other individuals, and legal entities without the consent whose rights may be violated from the commission of such misdemeanor;
10) leaving the classroom during the lesson without the teacher’s permission;
11) refusal to participate in compulsory community service and activities (cleaning of classes, territory, participation in social projects, activities, etc.);
12) failure to comply with the requirements of the accompanying supervisor during whole school events, extracurricular activities, cleanliness in accommodation, appearance, disrespect for local traditions, and historical and cultural monuments.
- Serious violations include:
1) repeatedly committed violations classified as major within 6 months from the date of commission, or commission of several major violations at the same time;
2) discrimination against someone because of language, gender, ethnicity, or religion;
3) imposition of religious views and beliefs, incitement of ethnic hatred, propaganda of aggression and violence;
4) the use, sale, distribution, bringing to the school premises and advertising of the following substances and products in and outside the Intellectual School: smoking and non-smoking tobacco products, electronic devices with smoking mixtures (including electronic cigarettes, vape, IQOS, Glo, flavorings and liquids for them, hookah, tobacco heating systems, nasvay, etc.); alcohol and alcoholic beverages (beer, gin and tonic and other beverages) as well as containers, bottles and tin cans intended for filling alcoholic beverages; energy drinks, narcotic, psychotropic, chemical and toxic substances, animal and insect poisons;
5) showing up at the Intellectual School and public places in a state of alcoholic, narcotic, toxic, or other intoxication;
6) violation of safety rules, fire safety rules on the territory of the Intellectual School, as well as during extracurricular activities;
7) carrying and distributing any weapons, sharp, cutting, stabbing objects, explosives, pyrotechnic, psychotropic chemicals, flammable substances, matches, lighters, flammable objects, and other things incompatible with the requirements for use in the educational process;
8) deliberate spoilage, damage to the property of the Intellectual School, members of the school community, other individuals and legal entities;
9) any form of sexual harassment, including actions of intimate and (or) sexual nature, creation and distribution of photo and video materials of those actions, as well as the threat of their use or distribution;
10) causing psychological and physical harm to a member of the school community, other legal institutions, or individuals (bullying, fights, hooliganism, actions of intimate and/or sexual nature, as well as all types of bullying, cyber-bullying);
11) theft, using other people’s belongings without the permission and knowledge of members of the school community, other legal institutions, or individuals;
12) dissemination of materials defaming the honor and image of the Nazarbayev Intellectual Schools, AEO, and its community members, including personal data, photographs, audio and video recordings, as well as filming, storing, and transmitting inaccurate or defamatory information using wireless data transmission means (AirDrop, WhatsApp, Telegram, Bluetooth, etc.), or transmitting such information to mass media and/or social network without the prior consent of individuals;
13) violation of the Academic Honesty Policy by students at the Intellectual Schools;
14) going outside the territory of the Intellectual School without the permission of the tutor, or administration.
- In case of disciplinary violations by students, the teacher and/or the tutor should file for an ACTA in the form according to Appendix 2 to these Rules.
Appendix 2 to these Rules.
In case of minor disciplinary violations, the teacher, the teacher-organizer-tutor, and the administration apply educational measures of influence under Appendix 3 to these Rules.
- To organize work on the prevention of offenses and strengthening discipline among students in an Intellectual school, a Disciplinary Committee is established.
The Disciplinary Committee examines minor, significant, and serious types of disciplinary violations.
- The composition of the Disciplinary Committee is approved by the order of the Principal of an intellectual school for each academic year. The disciplinary committee is headed by a chairman, which includes teachers, teachers-organizers-tutors, students, and representatives of the parent committee. The members of the Disciplinary Committee carry out their activities free of charge with a term of office of 2 years. After the expiration of the term of office, the members of the committee may not be re-elected to the Disciplinary Committee.
- The Disciplinary Committee, at its meetings, convened by the Chairman as necessary, considers the following issues:
1) Analysis of the state of discipline:
– study and analysis of the state of discipline among students;
– analysis of the effectiveness of educational and preventive work aimed at preventing violations of discipline;
2) Conflict situations:
– consideration of conflict situations related to the violation of discipline by students;
– identifying the causes of conflicts and developing measures to prevent them in the future;
3) Violations of these Rules:
– consideration of cases of violation of these Rules and other regulatory documents of the AEO;
– determination of disciplinary measures against students who have violated the rules;
4) Personal files of students:
– review of personal files of students who violate the law;
– assessment of the degree of guilt and determination of appropriate disciplinary measures;
5) Work with teachers-organizers-tutors and legal representatives:
– listening to teachers-organizers–tutors on the state of work on strengthening discipline and crime prevention;
– ensuring interaction between the school and the legal representatives of students to coordinate educational measures;
6) Monitoring of registered students:
– monitoring the behavior of students who have previously been disciplined;
– development and implementation of individual work plans with such students;
7) Preventive work:
– involving students who are prone to offenses in sports clubs, clubs, community service and other extracurricular activities;
– organization of individual work with students who are prone to offenses;
– carrying out preventive work with families aimed at improving the conditions of upbringing and education of children;
8) Evaluation of evidence and decision–making:
– review of evidence submitted to violations of discipline;
– making informed decisions about whether or not to hold students accountable based on facts and evidence.
- A meeting of the Disciplinary Committee is considered competent if more than two-thirds of its members take part in it. The decision of the Disciplinary Committee is made by a majority vote of the number of members present at the meeting.
The decisions of the Disciplinary Committee are advisory and are subject to approval by the principal of the Intellectual School, who makes the final decision.
The decision of the principal is issued by order and entered into the student’s file.
- The grounds for initiating a disciplinary misconduct review are:
1) a statement, complaint, written or oral communication, an act of violation submitted to the principal of an Intellectual School by members of the school community, by the injured party or other persons;
2) the statement (message) of the student who committed a disciplinary offense.
- The Deputy Principal for Pastory Work is obliged to notify one of the student’s legal representatives of the possibility of bringing him to disciplinary responsibility, to demand from the student an explanation in writing, which he, together with legal representatives, is obliged to submit within 1 (one) day. If the student refuses to explain, an act is drawn up, which is signed by three persons from among the teachers, teachers-organizers-tutors, and administrative and managerial staff.
- The student’s refusal to explain in writing does not prevent the application of a disciplinary measure against him.
- An employee of an Intellectual School who has a direct or indirect interest in its result (for example, a teacher against whom a student has committed a disciplinary offense) is not allowed to participate in deciding on a disciplinary offense. This employee can act as a witness but does not have the right to participate in decision-making or provide assistance influence on the members of the committee. Failure to comply with this requirement may result in the recognition of the results of the review as invalid.
- During the consideration of the committed disciplinary offense, the Disciplinary Committee establishes the following circumstances:
1) has there been a disciplinary offense (the fact of misconduct);
2) where, when, under what circumstances, and for what purpose it was committed (place, time, method);
3) what did he say;
4) a person who has committed a disciplinary offense;
5) the culpability of the action (inaction) of specific students, the form and degree of guilt each student in the committee of misconduct by several persons;
6) what are the consequences of misconduct;
7) circumstances mitigating and aggravating the student’s responsibility;
8) circumstances precluding disciplinary responsibility of the student;
9) the student’s previous and subsequent behavior;
10) the reasons and conditions that contributed to the commission of the offense;
11) the impact of disciplinary misconduct on the image of the AEO;
12) any possible conflicts of interest or bias among the members of the committee or other participants in the process;
13) compliance of the collected evidence with legal norms and internal rules Intellectual schools;
14) the impact of disciplinary misconduct on other students and the school community;
15) other facts that are important for the correct and objective consideration of disciplinary misconduct.
- The non-appearance of any of the participants in a disciplinary offense is not a reason for postponing consideration. In this case, the explanations received from other persons and the available materials are studied.
- Evidence of a disciplinary violation is any information, or factual data, based on which the Disciplinary Committee establishes the presence or absence of signs of disciplinary misconduct, and relevant circumstances.
All evidence is subject to verification for its reliability and admissibility.
Evidence obtained in violation of the law or procedures cannot be used in the consideration of the case.
The Disciplinary Committee has the right to request additional materials and information for a comprehensive and objective examination of the case. The disciplinary committee may involve specialists (for example, IT specialists to verify digital evidence) to establish the authenticity and significance of the evidence presented.
- As evidence, it is allowed:
1) Student’s explanations;
2) explanations of witnesses;
3) physical evidence;
4) documents;
5) the results of the examinations (if necessary).
Explanations are information related to the student’s disciplinary misconduct and disciplinary responsibility, which are communicated orally or in writing.
Any objects are recognized as material evidence:
1) which were used while committing a disciplinary offense;
2) to which the student’s actions were directed;
3) money, valuables, and other property received as a result of a disciplinary offense;
4) items and documents that have retained traces of disciplinary misconduct;
5) electronic devices and digital data related to the disciplinary offense.
The documents are significant for resolving the issue of the application of a disciplinary collection of information provided in writing. The documents may contain information recorded both in writing and in another form. These may include photo and film footage, audio and video recordings, electronic messages and correspondence, data from CCTV cameras, printouts of electronic documents, and other media.
- Disciplinary punishment may not be imposed during illness or during the absence of a student from an Intellectual School for a valid reason (being treated, at the funeral of relatives or close people, due to insurmountable events – force majeure).
- The Disciplinary Committee applies educational measures to a student who has committed a disciplinary violation under Appendix 3 to these Rules.
- Disciplinary measures include:
1) imposing the obligation to make a public apology;
2) remark;
3) reprimand;
4) severe reprimand;
5) expulsion from school.
- If the Disciplinary Committee issues a conclusion on the application of a measure in the form of expulsion of a student, a meeting of the Pedagogical Council is convened. By the decision of the Pedagogical Council, a student may be expelled from the Intellectual school.
- Students in respect of whom disciplinary misconduct is being considered, as well as their legal representatives, have the right to:
- get acquainted with the progress of the investigation of a disciplinary violation, give explanations, apply for a petition, and provide evidence;
- refusal to give explanations, in this case, the members of the Disciplinary Committee draw up a protocol for the student’s refusal to give explanations;
- the requirement of non-disclosure of the results of the work of the Disciplinary Committee before making a decision;
- obtaining a copy of the orders and other legal acts issued against the student.
- If a student’s disciplinary misconduct contains signs of a criminal or administrative offense, the principal of the Intellectual School notifies the legal representatives, the structural unit of the incident AEO, whose competence includes the organization of educational work, and law enforcement officers.
- The decision on the application of a disciplinary measure to a student is issued by a written order of the principal of the Intellectual School based on the protocol of the Disciplinary Committee, or the decision of the Pedagogical Council, materials containing actual evidence of his disciplinary offense.
- A copy of the order on the application of disciplinary punishment to the student, indicating the grounds for its application, is handed over to the student, and his legal representatives against receipt. In case of refusal of the student, his legal representatives to familiarize themselves with the order, a copy of the order is sent by registered mail with a notification of delivery.
- The principal of an Intellectual school has the right to remove a student`s disciplinary punishment on their initiative, at the request of the teacher, or representatives of student self-government bodies ahead of time, if the student has earned a conscientious attitude to study and has not allowed a new or repeated violation of discipline.
- A student is considered to have no disciplinary action from the moment of its removal or after 6 (six) months from the date of application of the last disciplinary action.
- The organization of interaction with legal representatives of students
- The tasks of organizing the interaction of the administration, teachers, teachers-organizers-tutors of the Intellectual School with the legal representatives of the students are:
1) involvement of legal representatives in the educational process through school self-government bodies (parent committee, board of trustees, incentive and disciplinary committees);
2) education of legal representatives about pedagogical knowledge and skills in the education of students (Parent University, video materials on the psychological aspects of the relationship between children and adults);
3) using the professional and personal experience of legal representatives in the educational process;
4) formation of an active position of legal representatives through the participation of the latter, including in festive, sports, leisure, and career guidance events.
- Organization of interaction between the administration, teachers, teachers-organizers-tutors of the Intellectual School with the legal representatives of the students presupposes:
1) the study of the family to identify its possibilities for the education of students;
2) advising legal representatives on improving child-parent relations and the well-being of the student at school and family;
3) organization and holding of an Open Day at the school for legal representatives with the right to attend any form of classes on that day.
- Administration, teachers, teachers-organizers-tutors
Intellectual schools are obliged to inform legal representatives about the behavior of their children and take joint measures against the negative behavior of students to correct it and prevent relapses.
Advisory interviews with legal representatives of students are conducted by employees of the Intellectual School.
- Resolution of disputes
- Students have the right to apply independently or through their legal representatives to the administration of the Intellectual School:
1) with statements on improving the educational process, quality teaching, the order of use of the library, canteen, medical services, and other structural units of the Intellectual School, to ensure the safety of students and on any other issues affecting the interests of students;
2) with applications for students and employees of the Intellectual School.
- Consideration of student complaints on controversial issues or claims occurs when there is a statement from the student or his legal representative, which should state the essence of the issue with specific facts.
- Anonymous appeals by the administration of the Intellectual School are not allowed
They are being considered.
- The administration of the Intellectual School carries out a personal reception of students and their legal representatives at a previously agreed time.
- Final provisions
- These Rules shall enter into force from the date of their approval by the decision of The Board of the AEO.
- These Rules, which eliminate disciplinary punishment for a violation, mitigate liability, or otherwise improve the situation of the person who committed the violation, are retroactive, that is, they apply to persons who committed the corresponding violation before these Rules came into force.
- Disciplinary proceedings initiated before the entry into force of these Rules shall be carried out under the Rules in force on the date of commencement of consideration of the violation.
